Major Responsibilities:
As a member of the Human Resources Senior Management Team, reporting to the Director, HR Systems and Management Services, the Manager, Fair Wage & Labour Office administers the Fair Wage By-law; enforces the Fair Wage Policy, Fair Wage Schedules and the Labour Trades Contractual Obligations in the Construction Industry; and manages the ongoing operation of the Fair Wage Office.
  • Ensures all suppliers and contractors engaged by the City of Toronto Divisions, Board of Governors of Exhibition Place and from time to time other City Agencies, adhere to the Fair Wage Policy and Labour Trades Contractual Obligations in the Construction Industry
  • Works with Purchasing & Materials Management Division staff to ensure appropriate Fair Wage and Labour Trade information is included in all procurement documents and provides clarifications in addendum to prospective vendors
  • In support of the City's procurement process, reviews contractors’ compliance with the Fair Wage Policy and provides results to the Purchasing & Materials Management Division and other appropriate divisions
  • Conducts investigations of firms on a scheduled basis and upon receiving legitimate complaints, which includes site visits, interviewing personnel, and reviewing payroll reports, books and documentation to ensure compliance with the Fair Wage Policy and Labour Trades Contractual Obligations
  • Determines compliance with the Fair Wage Policy and Labour Trade Agreements and makes recommendations to Government Management Committee and Council, including names of firms in violation, for disqualification from conducting business with the City of Toronto per the Fair Wage Policy
  • In consultation with Labour Relations and Legal Services, facilitates, mediates and resolves fair wage compliance issues and labour trade grievances, and attends Labour Board hearings as necessary
  • Liaises with contractors failing to comply with the Fair Wage Schedule with the view of resolving violations and paying any restitution owed to workers
  • Prepares documentary evidence for grievances, Labour Board hearings and court proceedings
  • Appears before the courts and/or other judicial tribunals (e.g. Ontario Labour Relations Board) representing the City of Toronto Fair Wage Office, as required
  • Prepares reports to the Purchasing & Materials Management Division and other City of Toronto Divisions after verifying compliance with the Fair Wage Policy and Schedules
  • Prepares reports to the City of Toronto Government Management Committee and City Council, as required on all matters pertaining to the Fair Wage Policy and Labour Trade Agreements
  • Conducts research with trade unions, association representatives and non-union contractors to consult on current wage rates, fringe benefits and working conditions to be used as standards for the Fair Wage Policy and the establishment of Fair Wage Schedules
  • Conducts surveys to establish wage rates and fringe benefits for non-union industries
  • Consults with the appropriate industry representatives on work jurisdiction issues pursuant to Labour Trades Contractual Obligations in the Construction Industry
  • Reviews and analyzes legislative and labour relations trends and developments in a variety of industries (e.g. issues, legislative changes, applicable Labour Board and court decisions)
  • Supports the Auditor General’s Office Fraud and Waste Hotline investigations
  • Maintains accurate and detailed documentation and records in the Fair Wage Information System, tracking complaints, investigations, non-compliance with the Fair Wage Policy and/or Labour Trades Contractual Obligations in the Construction Industry and the disposition of each incident
  • Ensures City of Toronto contractors, suppliers and internal operating divisions are educated and aware of the process and requirements related to the Fair Wage By-law and legislated labour trade obligations
  • Responds to internal and external enquiries relating to the Fair Wage Policy and Schedules including from Councillors and the media
  • Manages the operation of the Fair Wage Office, ensuring appropriate program policies, procedures and processes are in place and kept current
  • Manages staff, budget and reporting of performance measures
  • Troubleshoots issues, creates and implements solutions and escalates appropriate enforcement reporting
  • Participates on City of Toronto corporate and divisional project teams as appropriate

Key Qualifications:
  1. Post-secondary education in a professional discipline pertinent to the job function combined with relevant management training and experience, or the equivalent combination of education and/or experience.
  2. Considerable experience in conducting compliance-related investigations and reporting on findings.
  3. Considerable experience working with trade unions, collective agreements and labour legislation.
  4. Experience in effectively developing and managing diverse and high-performing teams to deliver strong organizational outcomes.
  5. Experience with formal public sector procurement processes, including the identification of project scope and construction sector trade work jurisdiction.
  6. In-depth knowledge of the construction industry, service industries and craft trades.
  7. Skilled in mediation/negotiation, problem solving and conflict resolution in situations with a high degree of sensitivity and confidentiality.
  8. Ability to establish effective working relationships with staff at all levels within the organization, elected officials, contractors/suppliers, workers within a variety of industries, trade union representatives and external agencies.
  9. Knowledge of basic accounting principles and effective application of financial analysis of private sector business operations and Ontario employment legislation.
  10. Collaborative team player with the ability to interact and communicate effectively, both orally and in writing, at all organizational levels.
  11. Ability to exercise discretion, judgement, and political acumen to deal with sensitive and confidential issues.
  12. A strong customer service focus with the ability to represent the Division professionally with senior staff, standing committees, Council and stakeholders.
  13. Ability to foster an organizational culture that emphasizes high professional and ethical standards to support public service excellence.
